July 11 (Reuters) - A 46-year-old homeless man with no arms was arrested in Miami Beach, Florida, for stabbing another man with a pair of scissors using his feet, police said on Wednesday.

And on top of that...

Man wasn’t drinking while driving, just sipping at stop signs, he told deputies
VERO BEACH, Fla. — A man who told officers that he had been charged twice for drunken driving in Missouri assured them he was not drinking and driving this time when he was questioned in a McDonald's parking lot here.

Instead, Earle Stevens Jr., 66, of Vero Beach was downing bourbon only while stopped at traffic signals and stop signs, he told investigators June 27.

This probably belongs in a different thread but the law here is "...if the person operates or drives a motor vehicle...". When I served on grand jury the vague definition of "operates" was used to successfully charge a man with DUI who went out to his vehicle and with keys in his pocket proceed to sleep it off in the passenger's seat. Because he was "capable of starting the car" he was considered to be "operating" it. I argued hard against that one to no avail.

When I was younger and drunker, folk wisdom as promulgated by the Army was that you could be charged with DUI being passed out in the car if you had the keys on your person or readily accessible. So we put the keys in the trunk or similar places to avoid charges.

Some young cowboys in Prescott Arizona decided to save money on a motel room by renting spaces in the parking garage right behind Whiskey Row. Cops woke 'em up to charge them with DUI, charges stuck because they had access to their keys.

This makes no sense. They would have had equal 'access to their keys' in a motel room. JFC, this is a prime example of the libertarian dictum that authorities will ALWAYS abuse any power granted to them.

As a friend of mine puts it, a person can get a DUI in Arizona by being drunk on a non-functional riding lawnmower that's parked on blocks in their backyard. The DUI laws here are absurd. They incentivize driving home drunk rather than parking and sleeping it off.

Yeah, there's less of a chance getting caught and charged driving drunk than parking on the side of the road to sleep it off. Fucking Leviathan.
