Re: Elizabeth Warren's

You are acting like there’s not a million pages of finanable and criminal regulations already. Yeah, with such results as "GM was fined about one-half of one percent of its value for killing 120+ people, injuring hundreds more and letting at least one innocent victim take a felony rap." (I don't kn...

Re: Cooling down: a more palatable thread?

Today, at the Indian supermarket where Jeff and I regularly shop, there was a guy making and selling fresh-squeezed "sugarcane juice": he'd put four or five rather thick sticks of what is presumably sugarcane into a machine, and they came out the other side thoroughly flattened, while juice poured o...

Re: Elizabeth Warren's

That still doesn't make this a good idea. But I have not yet see anyone argue why the current status quo -- "the company MUST survive, no matter how many crimes the company (as opposed to individual rogue employees acting on their own) has committed" -- is any improvement. Oh yeah it's an improveme...

Re: Elizabeth Warren's

So what if the status quo is better than a corporate death penalty? Who says those are or should be the only options? Apologists win with false dichotomies. Upthread I did speculate about possible ways to implement "corporate imprisonment" instead -- an individual who committed Wells Fargo fraud wo...

Re: Elizabeth Warren's "Accountable Capitalism Act"

If "subjective" enforcement is the concern, perhaps writing up some "objective" standards would help. There are already standards in place for individuals who commit certain crimes -- if a rogue bank employee on his own decided to commit Wells Fargo-level fraud against certain of his customers, what...

Re: Horrible, Offensive Geekery

I think peaceful cooperation is an underappreciated reality in crises. I kinda buy the argument that most post-apocalyptic stories are built on a foundation of misanthropy, which is why they tend to focus on barbarity and violence that we don't generally see in disasters. This is true -- in cases s...

Re: Elizabeth Warren's

Corporate existence at the whim of government is a full on retarded and destructive policy. But isn't "corporate" existence (as a specific type of business venture) essentially a government invention anyway? By which I mean: my understanding of basic back-of-a-cereal-box Corporate Law is that incor...

Re: Elizabeth Warren's "Accountable Capitalism Act"

I just now remembered a vastly more egregious example of corporate criminality (bad as Wells Fargo was, IIRC nobody actually died over their fraudulent activities): GM's faulty ignition switches. They knew the switches were bad, they knew the bad switches were killing people, they knew at least one ...

Re: Marriage is Totally Gay

No sale. Discriminating against homosexuals is not sex discrimination. Whether you choose to be a homosexual or not, getting gay married is an action that you choose. And as you yourself have just pointed out, some people think that action is despicable. How is that any different from "Marrying som...

Re: Elizabeth Warren's "Accountable Capitalism Act"

If a "corporate death penalty" is not feasible, I wonder if it would be feasible to do something akin to "corporate imprisonment" -- what could be done to a company, such as Wells Fargo, that would affect the company the same way "You're going to prison for ten years" would affect an individual? I d...

The perverse incentives that come with it would be legion.
The perverse incentives that came from letting sufficiently large companies commit crimes effectively without penalty haven't been all too great either, though.

Re: Elizabeth Warren's "Accountable Capitalism Act"

As has been mentioned upthread, part of the problem is that there's no effective means of punishing companies/organizations for crimes. If a rogue individual bank employee pulled the type of fraud which Wells Fargo did as a matter of course, that individual would go to jail for upwards of a decade. ...

Re: Elizabeth Warren's "Accountable Capitalism Act"

I think she was trying to make a point about completely corrupted organizations. It's certainly not an exact metaphor, but I understood her point. It's also notable that the Catholic Church, like Wells Fargo, can be credited with some good works as well as terrible activities. I'm not sure the for-...

Re: Horrible, Offensive Geekery

The margin between "smashing all advanced civilization and knowledge" and "wiping out the species" is really, really narrow, though. A lot narrower than the space most post-apocalyptic stories exist in. A magical super-plague wouldn't prevent the immediate survivors from seeking out and retaining u...

Re: The son of "What the hell are YOU staring at?"

I saw "American Satan," which was a very funny movie, except I don't think it was supposed to be. The premise is that all those people (especially during the '80s "Satanic Panic") who freaked out about rock-n-roll being the devil's music were right all along. So now (2017, when the movie came out), ...
