It is exactly what people are doing when asked "What's the legal basis for deploying ground troops to Syria?" Pretty much. The post-9/11 AUMF seems to be treated as authorization to get involved in any fight where at least one combatant is either a Muslim or has Muslim friends. ... or is brown.

It was Hamilton's opinion, fwiw. Also, there's the position that even special prosecutors work for DoJ, which works for the president, who theoretically can fire with impunity anyone in the Executive Branch except the VP.
